EMPLOYMENT POSTERS IN INDIANA

Employers are required by both state and federal governments to display various posters in their facilities to notify employees, and possibly applicants for employment, of certain benefits or rights they have under the law.

In this article, we list the posters that we have found are required by either the state of Indiana or the federal government to be displayed in an employer's facility. You also should check the laws of any local government (e.g. , a city) in which you are located. Most, if not all, of the listed agencies will send the required posters upon request at no charge.

The posters must be displayed in a conspicuous location.

We think our list is complete, but, if you know of a poster we missed, please let us know. We will check concerning it and, if it is required, will include it in an update of this article.

Indiana Minimum Wage Law

An individual employer, partnership,
association, corporation, business trust, the
state, or other governmental agency or
political subdivision during any work week
in which they have two or more employees
shall keep a copy posted of Indiana Minimum
Wage Law and Regulations in a conspicuous
place in the area where employees are employed.

Indiana Minor Labor Law

Every person, firm, corporation, or company
which employs any child who is 14 years of
age or older and less than 18 in an occupation
for which an employment certificate must be
obtained shall post in a conspicuous place, or
in places where notices to employees are
customarily posted, a printed notice stating:
(1) the maximum number of hours children
may be employed or permitted to work in
each day of the week; (2) the hours of
beginning and ending each day; and (3) the
names and ages of the children employed.

Indiana Occupational & Safety Law

Every individual, or type of organization,
including the state and all its political
subdivisions, that is employing one or more
persons shall post this notice which describes
the protections and obligations of employers
under Indiana's Occupational & Safety Act.  It
must be posted in a conspicuous place. Also,
the federal OSHA Form 200 must be posted
during the month of February, summarizing
the preceding year's occupational illnesses
and injuries (that form can be obtained from
the federal OSHA office stated later in this listing).

Indiana Unemployment Compensation Law

Employer's subject to the law must post a
notice to employees informing them of
their rights under this law.

Indiana Worker's Compensation

Employers subject to the law must post their
own notice in a conspicuous place informing
employees that their employment is covered
by worker's compensation.  The notice must
also include the name, address, and phone
number of the insurance carrier.  If the
employer is required by federal law or
regulation to post a notice for the employer's
employees, the notice required under this
law must be posted in the same location(s)
of the federal notice.  Employers subject to
this regulation can get guidelines from
Indiana's Workers Compensation Board. 
Also, an employer's worker's compensation
carrier may already have their own posters
or poster templates that an employer can
use in the workplace.

Fair Labor Standards Act (FLSA)

Every employer subject to the FLSA must post
this notice in a conspicuous place in every
establishment where employees are employed so
it can be observed.  The poster outlines the law
regarding minimum wage, overtime pay, equal
pay for equal work, child labor, student or
apprentices or handicapped workers.

Family and Medical Leave Act (FMLA)

Generally, all private employers employing 50
or more employees for each working day during
each of 20 or more calendar workweeks in the
current or proceeding year as well as public
employers and private elementary and secondary
schools are required to display this poster in a
conspicuous place.  The poster summarizes the
major provisions of the FMLA and tells
employees how to file a complaint.

Employee Polygragh Protection Act

Employers engaged in commerce or show
business affects commerce must post notice in a
place where all employees and job applicants
can see it.  Federal, state and local governments
are exempt but most private employers are
covered by the law.

Migrant and Seasonal Agricultural Worker Protection Act (MSPA)

Each farm labor contractor, agricultural
employer and agricultral association which
employs any migrant agricultural worker shall
post in a conspicuous place this poster
explaining the rights and protections for
workers required under the Act.

Notice to Workers with Disabilities/Special
Minimum Wage

Every employer of workers with disabilites
under special minimum wage certificates
authorized by the Fair Labor Standards Act, the
McNamara-O'Hara Service Contract Act, and/or
the Walsh-Healey Public Contracts Act shall
display a poster explaining the conditions under
which special minimum wage may be paid.
The poster shall be displayed in a conspicuous
place on the premises where employees and the
parents or guardians of workers with disabilities
can see it.

Davis-Beacon Public Contracts Act

All construction contractors and sub-contractors
working on federally financed construction must
post at the job site a copy of the specifications
section of their contract with the federal
government setting forth applicable prevailing
wage rates as determined by the Secretary of
Labor.

Walsh-Healy Public Contract Act or Service
Contract Act of 1965

The Contract Act applies to all employers under
contract with the federal government to produce
or furnish materials, supplies, articles or
equipment in an amount of $10,000 or more.
The Service Contract Act has identical
requirements for contracts for services in excess
of $2,500.  Postings of the Acts must be in a
sufficient number of places to permit employees
to observe a copy.

Uniformed Services Employment and
Reemployment

Employers are required to provide to persons
entitled to the rights and benefits under the
Uniform Services Employment and
Reemployment Rights Act ("USERRA"), a
notice of the rights, benefits and obligations of
such persons and such employers under
USERRA.  Employers may meet this obligation
by posting this notice in a conspicuous place.
